Residential status of an individual under Section 6 in income tax: excerpt from page 12 of the BBA 212 notes
Excerpt from page 12
Tax liability depends on residential status, not citizenship. A foreign citizen can be resident in India and an Indian citizen can be non-resident. Status is fixed separately for each previous year, so it can change from one year to the next.
Step 1: basic conditions under Section 6(1)
An individual is resident if any one basic condition is met:
- (a) a stay in India of 182 days or more in the relevant previous year; or
- (b) a stay of 60 days or more in that year and 365 days or more in the four years immediately before it.
If neither condition is met, the individual is non-resident, subject to the deemed-resident rule below.
When the 60-day condition is replaced
- An Indian citizen who leaves India during the year for employment abroad, or as a crew member of an Indian ship: 60 days becomes 182 days.
- An Indian citizen or Person of Indian Origin visiting India: 60 days becomes 182 days. If total income other than foreign-source income exceeds ₹15 lakh, it becomes 120 days, and the 365-day condition still applies.
In practice only the 182-day test applies to these persons, except in the ₹15 lakh case.
Step 2: additional conditions for ROR under Section 6(6)
A resident individual is Resident and Ordinarily Resident (ROR) only if both are met: (1) resident in at least 2 of the 10 previous years before the relevant year, and (2) a stay of 730 days or more in the 7 years before it. If either fails, the person is Resident but Not Ordinarily Resident (RNOR). Put the other way, someone who was non-resident in 9 of the last 10 years, or stayed 729 days or less in the last 7, is RNOR.
Special cases treated as RNOR
- A visiting Indian citizen or PIO with Indian income above ₹15 lakh who becomes resident only because of the 120-day rule.
- A deemed resident under Section 6(1A).
Deemed resident: Section 6(1A)
An Indian citizen whose total income, other than foreign-source income, exceeds ₹15 lakh in the year, and who is not liable to tax in any other country because of domicile or residence, is deemed resident in India and is always treated as RNOR. The purpose is to tax "stateless" Indians who avoid tax everywhere.

How to write BBA 212 answers: computation statements with working notes, regime choice and section-backed theory
BBA 212 answers are either computations (salary, house property, business income, capital gains, total income) or theory that must cite the right section. Most long questions in the exam corners mix both: a short explanation, then a numerical.
- Computations. Use two columns, Particulars and ₹, in the format the notes print for that head. Put a working note under the statement for each exemption, such as HRA, gratuity or commuted pension, and give a reason for every item, for example "rent from Delhi property accrues in India, hence taxable for all".
- Regime and order. If no regime is named, the notes solve under the default new regime and mention the old one can be opted. Show special-rate income separately, deduct the 87A rebate before 4% cess, round total income and tax to the nearest ₹10 (Sec. 288A and 288B), then name the cheaper regime.
- Mistakes the notes flag. Deducting municipal tax paid by the tenant, allowing actual repairs on top of the 30% deduction, allowing a provision for bad debts, using 36 months for land, and claiming HRA or 80C under the new regime.
- Theory. Open with the section and definition, such as the five elements of Section 4 or the Section 2(47) meaning of transfer, then add the comparison table the notes give, for example cash against mercantile accounting or exempt income against deduction. Short notes get the section number and one example.
Worked example: gratuity (page 29)
Mr. Chopra, covered by the Gratuity Act, retires after 25 years 7 months on ₹52,000 a month basic + DA and gets ₹8,00,000. Count 26 years, as 7 months exceeds 6. Limits: 15/26 × 52,000 × 26 = ₹7,80,000, the ₹20,00,000 cap and the actual ₹8,00,000. Exempt is ₹7,80,000, so taxable gratuity is ₹20,000.
Practise this format on the GGSIPU BBA important questions.
BBA 212 income tax notes FAQs
How do I get the full BBA 212 notes?
Message Unnati Educations on WhatsApp at 9899436384 using the "Get Full Notes" button on this page. The full BBA 212 notes come as a printed book, not as a PDF. Once your order is confirmed, the book reaches you within 5 to 7 days at most, depending on your location. The 66-page book covers all four units with 26 numbered illustrations.
Is BBA 212 compulsory for every GGSIPU BBA student in Semester 4?
No. BBA 212 is the Finance option among five Semester 4 specialisation electives. Each student picks two electives from different specialisations, one for the major and one for the minor. BBA 212 counts as a Discipline Specific Course if Finance is your major and as an Inter-disciplinary Course if Finance is your minor, carrying 4 credits either way.
Which tax year do the BBA 212 notes follow, and do they cover the Income-tax Act, 2025?
The BBA 212 notes compute every illustration for FY 2025-26 (AY 2026-27). They keep the 1961 Act section numbers that the syllabus uses and add update boxes on the Income-tax Act, 2025, which applies from 1 April 2026 and uses one "tax year". Ask your teacher which assessment year your BBA 212 exam numericals will follow.
What is the passing mark for BBA 212?
BBA 212 is marked out of 100: 40 internal and 60 end-term. The internal 40 is a compulsory class test of 15 marks plus 25 marks for at least two activities such as assignments or viva-voce. The BBA scheme does not state a pass percentage, so end-term minimums and re-appear rules come from GGSIPU Ordinance 11 on ipu.ac.in.
Do the BBA 212 notes solve numericals under both the old and the new regime?
Yes. Three BBA 212 illustrations run both regimes side by side: a ₹15 lakh salary with 80C and 80D investments in Unit 1, a Delhi salary with HRA in Unit 2, and a full total-income computation with house property, STCG and TDS in Unit 4. Each ends by naming the cheaper regime, the way the notes suggest closing exam answers.
Does BBA 212 cover e-filing of ITR-1 and ITR-2?
Yes. Section 4.8 of the BBA 212 notes, on pages 62 and 63, covers Section 139 due dates, who can and cannot use ITR-1 and ITR-2, how to choose Regime 1 or 2 in the return, and eleven portal steps from preparing documents to e-verification within 30 days. Hands-on filing, as the syllabus asks, happens in class.
